HERE IS A BASIC IDEA OF WHAT YOU CAN EXPECT IN A "TYPICAL" JUVENILE CASE

The  Juvenile Court hears almost all cases involving allegations of deprivation or unruly conduct of children under the age of eighteen, or delinquency or traffic violations concerning children under the age of seventeen. Typically, these offenders are out of jail pending formal charging.

Like adult courts, typically the juvenile appears for an arraignment, at which time the juvenile enters a plea of true or not true.

From there, the juvenile exercises their rights which are,

1. The Juvenile does not have to admit to the charges against me or even say anything at all, and that if the juvenile
choose not to say anything it will not be used against them.


2. The Juvenile has the right to have the charges against them served upon them in writing within a reasonable
time.


3. The Juvenile has a right to have a lawyer represent them,

4. the right to have a trial before the judge,

5. to have witnesses there to testify for them,

6. to question anyone who might testify against them,

7. the right to an appeal from the trial, if the juvenile disagrees with the decision,

8. the right to receive a record and/or transcript of the proceedings in the event of an appeal.

If convicted, the juvenile could be subject to the following punishments or a combination thereof:

1. dismissal,

2. informal adjustment,

3. probation,


4. commitment to the Department of Human Resources,

5. commitment to the Department of Juvenile Justice not to exceed sixty months,

6. placement in an institution,

7. placement in the custody of the Division of Family and Children Services,

8. community service,

9. suspension of driving license privileges,

10. requiring school attendance,

11. restitution.
